The Economy Minister will travel to Washington, where American investors are pressing against Cristina Kirchner’s decision not to pay the “vulture funds” 

It will be interesting to see.  Economy Minister Hernan Lorenzino will come within the week to this city to speak about the Argentine debt default and the decision not to pay the holders of bonds that continue to sue over that commitment.

Lorenzino’s arguments will be the first every publicly mounted by the Argentine government in this city, where the strongest actions have been concentrated by American investors against the decision by the government of Cristina Kirchner to not pay the so-called “vulture funds”.

The decision lines up within what Ambassador Jorge Arguello called the “need to dispel erroneous ideas” about our country’s debt and “proportion a response to the repeated questions around” the issue.

In fact, weeks ago the ambassador mounted an “information” campaign about Argentina which includes the sending of a regular newsletter to the main centers of political decision-making in the city.

In recent months, the government of Barack Obama applied a series of pressures on our country over the non-payment of its obligations.  First, it began to vote against credits for the country from multilateral credit organizations, like the Inter-American Development Bank (IADB) and the World Bank.

Shortly ago, Obama himself personally suspended tariff benefits for Argentina for the same reason.  Now, there is pressure in the U.S. Congress to “suspend” Argentina as a member of the G-20.

Lorenzino’s intervention in this city will come only two days before President Cristina Kirchner arrives in New York to speak about the Malvinas and, possibly, to defend the economic “model” – including the debt policy- before economic players.

The minister will speak at the embassy and it will be on the occasion of presenting the book, “Argentina and the Default of 2001: Myths and Realities”, a text dedicated, precisely, to evaluating the debt crisis of our country.

El ministro de Economía viajará a Washington, donde inversores norteamericanos presionan contra la decisión de Cristina Kirchner de no pagar a los "fondos buitre"

WASHINGTON.- Será interesante de ver. El ministro de Economía, Hernán Lorenzino, vendrá dentro de una semana a esta ciudad para exponer sobre el default de la deuda argentina y la decisión de no pagar a los tenedores de bonos que aún reclaman por ese compromiso.
La argumentación de Lorenzino será la primera que públicamente monta el gobierno argentino en esta ciudad, donde se concentran las acciones de presión más fuerte de inversores norteamericanos contra la decisión del gobierno de Cristina Kirchner de no pagar a los llamados "fondos buitre".
La decisión se alinea dentro de lo que el embajador Jorge Arguello definió como "la necesidad de despejar ideas erróneas" sobre la deuda de nuestro país y "proporcionar una respuesta a las reiteradas preguntas acerca" de la cuestión.
De hecho, desde hace semanas, el embajador montó una campaña de "información" sobre la Argentina, que incluye el envío de un boletín quincenal a los principales centros de decisión política de la ciudad.
En los últimos meses, el gobierno de Barack Obama aplicó una serie de presiones a nuestro país por el no pago de sus obligaciones. Primero, dispuso votar en contra de los créditos que el país gestiona ante organismos multilaterales de crédito, como el Banco Interamericano de Desarrollo (BID) y el Banco Mundial (BM).
Hace poco, el propio Obama en persona ordenó suspender beneficios arancelarios a la Argentina por la misma razón. Ahora, hay presiones en el Congreso norteamericano para "suspender" a la Argentina como miembro del grupo del G-20.
La intervención de Lorenzino en esta ciudad ocurrirá apenas dos días antes de que la presidenta Cristina Kirchner se presente en Nueva York para hablar de Malvinas y, posiblemente, defender "el modelo" económico -incluida la política de deuda- ante actores económicos.
El ministro hablará en la embajada y será ocasión para presentar el libro La Argentina y default de 2001: Mitos y realidades, un texto dedicado, precisamente, a evaluar la crisis de endeudamiento de nuestro país..

In den Jahren 2004/05 gelang erstmals zu Gunsten zweier Inhaber unbedienter argentinischer Staatsanleihen (unter deutschem Recht begeben) eine definitive Vollstreckung und Pfändung vs. die Republik Argentinien. Es wurden vergessene Zahlstellengelder (214.967,56 € bei der Credit Suisse, 124.470,64 € + 1.040,10 € bei der Deutschen Bank und 20.814,75 € bei der Dresdner Bank) am Bankenplatz Frankfurt gepfändet und nach § 839 ZPO beim Amtsgericht Frankfurt hinterlegt.

Elliott Management Corp., the hedge fund founded by billionaire investor Paul Singer, won support from a former official in President George W. Bush’s administration as it seeks payment on bonds Argentina defaulted on in 2001.
Kenneth Dam, who was deputy U.S. Treasury secretary under Bush, urged the U.S. Court of Appeals in New York last month to uphold rulings directing Argentina to settle in full with Elliott’s NML Capital unit when it makes payments on bonds issued in 2005 and 2010 restructurings. The court is scheduled to hear oral arguments on the appeal the week of June 18.

Dam’s “friend of the court,” or amicus, brief follows one filed in April on behalf of the Argentine government by the U.S. Justice Department, which said lower-court rulings in favor of NML’s so-called pari passu argument could hurt other restructurings by rewarding investors who hold out while punishing participants.
“Elliott is presumably trying to offset the Justice amicus brief by bringing in a former Treasury official,” said Mark Weidemaier, a law professor at the University of North Carolina at Chapel Hill who conducts research on international financial contracts.
NML Capital has won five judgments totaling $1.6 billion and has six other lawsuits pending judgment, according to court filings. The fund has yet to receive any payout from its Argentina-related court awards.

‘Pari Passu’

Manhattan U.S. District Judge Thomas P. Griesa’s Feb. 23 ruling, which Argentina is appealing, interprets “pari passu” clauses in sovereign debt contracts to mean that NML Capital’s judgments related to defaulted debt should be treated with equal ranking as restructured debt.
Dam wrote in his brief that collective action clauses, which allow a defined majority of bondholders to impose debt restructuring terms on all bondholders, have eliminated the threat from holdouts.
“The U.S. expresses concern in its brief that the district court’s ‘equal treatment’ interpretation of the pari passu clause will negatively affect the ability of countries to restructure their debt,” Dam wrote. “Given the widespread prevalence today of collective action clauses -- about 83 percent of the presently outstanding bonds of foreign sovereigns issued under New York law contain them -- this concern has no real basis.”

Solicitor General

Dam, now a professor emeritus at the University of Chicago Law School, has also held positions in the U.S. State Department and the White House Office on Economic Policy, according to his filing. Former Bush U.S. Solicitor General Theodore Olson, now a lawyer at Gibson Dunn & Crutcher LLP, is representing Singer’s fund before the appeals court.
Dam didn’t return a phone message and e-mail sent to his law school office seeking comment on the filing. Peter Truell, a spokesman for New York-based Elliott Management, declined to comment.
Carmine Boccuzzi, a lawyer with Cleary Gottlieb Steen & Hamilton LLP representing Argentina, didn’t immediately return a call seeking comment.
The case is NML Capital Ltd. v. Republic of Argentina, 12-00105, U.S. Court of Appeals for the Second Circuit (Manhattan).
